Terms & Conditions
These Terms & Conditions explain the basis on which High Toned Watches provides its website, sells and sources luxury watches and other items, purchases watches from clients, accepts part exchanges and provides related services.

Please read these Terms & Conditions carefully before entering into a transaction with High Toned Watches. They are designed to explain how our enquiries, sales, purchases, part exchanges, sourcing and related services operate. Where you are acting as a consumer, nothing in these terms is intended to remove or reduce rights that cannot lawfully be excluded.

About High Toned Watches & these terms
These Terms & Conditions apply to your use of hightonedwatches.com and, where relevant, to transactions and services agreed with High Toned Watches Ltd (“High Toned Watches”, “HTW”, “we”, “us” or “our”).
Our website is primarily an enquiry and information platform. Watches and other items displayed on the website cannot currently be purchased through an online checkout. A transaction may instead be discussed and agreed with us in person or remotely by telephone, email, WhatsApp or another agreed communication method.
Separate policies, including our Privacy Policy, Cookie Policy, Returns & Refunds Policy and Complaints Policy, should be read alongside these terms where relevant.

Eligibility & customer information
You must be at least 18 years old and legally capable of entering into a binding contract to buy an item from us, sell an item to us, enter into a part exchange or instruct us to provide a service.
You are responsible for ensuring that information you provide to us is complete and accurate. We may request appropriate identification, proof of address, proof of ownership, source-of-funds information or other information where reasonably required for security, fraud prevention, legal or transaction-verification purposes.

Website listings, availability & enquiries
Items displayed on our website are subject to availability and may be sold, reserved or withdrawn before the website is updated. An enquiry about an item does not reserve it and does not oblige HTW to sell it.
Because luxury watches can sell quickly and may be individually sourced, we cannot guarantee that a particular item will remain available while an enquiry or transaction is being discussed.
We may correct website errors, descriptions, availability information or pricing information where an error is identified. If an error materially affects a transaction already being discussed, we will explain this before the transaction is concluded wherever reasonably possible.

Product descriptions, images & pre-owned condition
We take reasonable care to describe watches and other items accurately. Many items offered by HTW are pre-owned or vintage and may show signs of age, wear, previous servicing, polishing or ownership consistent with their stated condition.
The availability of original boxes, papers, warranty cards, service records, spare links, straps and other accessories varies between individual items. What is included with a particular item should be confirmed as part of the sale.
Product imagery is shown for illustrative purposes only. Due to variations in studio lighting, digital photography and individual screen settings, the exact colour and metallic lustre of a dial, precious metal, leather or other material may vary slightly in person.
Where an item has characteristics that are material to your decision, you should raise them with us before completing the purchase.

Prices, deposits & payment
Unless otherwise stated, prices are quoted in pounds sterling. The price applicable to a transaction will be the price agreed between you and HTW before the sale is concluded.
Where a deposit or other advance payment is requested to reserve an item, source a watch, commence bespoke work or progress another service, the amount and any specific conditions applying to that payment should be confirmed to you before payment is made.
We may decline, pause or cancel a transaction where a payment cannot be verified, where requested security or compliance information is not provided, or where we reasonably suspect fraud, unlawful activity or unauthorised use of a payment method.

When a sale is agreed
Website listings and discussions with our team are invitations to enquire and do not, by themselves, create a binding contract of sale.
A sale is concluded when the material terms of the transaction have been agreed and accepted by both you and HTW and any payment or other condition required for the transaction to proceed has been satisfied.
For remotely agreed transactions, written confirmation, an invoice, payment request or other transaction communication may record the terms agreed between us.

Collection, delivery & risk
The method of collection or delivery will be agreed for the individual transaction. High-value items may be subject to additional identification, address, security, signature or delivery requirements.
Please inspect an item promptly after collection or delivery and contact us as soon as reasonably possible if you believe there is a problem, transit issue or discrepancy.
Where an insured courier or delivery service is arranged, responsibility and risk will be determined by the applicable law and the arrangements agreed for that transaction. Nothing in these terms limits rights that cannot lawfully be excluded.

Returns, cancellations & faulty goods
Our Returns & Refunds Policy forms part of the information governing applicable returns and cancellations and should be read before completing a purchase.
We do not offer a general change-of-mind return right for purchases made in person. Where a transaction is an eligible distance contract, statutory cancellation rights may apply. Bespoke, personalised and custom-made items cannot normally be cancelled or returned for change of mind where the applicable legal exception applies.
Your statutory rights in relation to goods that are faulty, not as described or otherwise do not conform to the contract are not affected by these terms.

Authentication, watches & provenance
HTW takes reasonable steps to verify the authenticity of watches and other high-value items that it offers for sale. Authentication is considered using the item itself and any relevant information or documentation available to us.
Original manufacturer paperwork may not be available with every pre-owned or vintage watch. The absence of original papers does not by itself mean that a watch is not authentic.
Unless expressly stated otherwise, HTW is an independent luxury watch business and is not the manufacturer of the watches it sells. References to manufacturers, model names and trademarks are used to identify and describe genuine products.

Selling a watch to HTW
Any initial valuation, estimate or indication of value provided before physical inspection is provisional and is not an obligation on HTW to purchase your watch.
Before making a final purchase offer, we may inspect the watch and carry out checks relating to its identity, authenticity, condition, serial or reference information, ownership, provenance, accompanying documentation and any other matter reasonably relevant to the proposed purchase.
A final offer may differ from an initial valuation where inspection or further information changes our assessment of the watch. You are not obliged to accept a revised or final offer unless you have separately agreed otherwise.
If we decline to purchase the watch, or you decline our final offer, appropriate arrangements will be made for collection or return where the watch is already in our possession, subject to any separately agreed arrangements.

Your promises when selling to us
By offering a watch or other item to HTW, you confirm that you are legally entitled to sell it and that the information you provide about it is accurate to the best of your knowledge.
You must tell us about any matter that may materially affect ownership, authenticity, provenance, value or our ability to purchase or resell the item. In particular, you must not knowingly offer us an item that is stolen, counterfeit, subject to an undisclosed finance agreement, lien, charge, insurance claim or other third-party ownership or security interest.
We may require proof of identity, proof of ownership or purchase, supporting documentation and further information before proceeding. If a check raises a concern, we may suspend or decline the transaction and take any steps required by law.

Part exchange
Where HTW agrees to accept your watch as part payment towards another item, the valuation of your watch and the price of the item you are acquiring form part of the overall part-exchange transaction.
Any preliminary part-exchange valuation is subject to physical inspection and verification in the same way as a watch offered for outright sale to HTW. The final valuation may therefore change following inspection.
You confirm that a watch provided in part exchange is yours to transfer and is free from undisclosed third-party claims or finance. Any additional balance payable by either party will be agreed as part of the transaction.

Watch sourcing
Where you ask HTW to source a particular watch, we will use reasonable efforts to locate an item matching the specification discussed with you, but we do not guarantee that a particular watch can be sourced within a specific period or at a particular price unless this has been expressly agreed.
Market availability and pricing for luxury watches can change quickly. A sourcing indication or estimated price is therefore not necessarily a binding offer.
If a sourcing instruction requires a deposit or commitment before we acquire an item specifically for you, any material deposit, cancellation or sourcing conditions will be communicated as part of that arrangement.

Bespoke & custom-made pieces
Bespoke, personalised and custom-made jewellery or other pieces are produced or altered to an individual specification. You are responsible for checking and approving the relevant specification, design details, sizing and personalisation before production where approval is requested.
Timescales for bespoke work are estimates unless expressly agreed otherwise and may depend on design approval, materials, manufacturing and third-party suppliers.
Because bespoke and personalised items are made specifically for the client, change-of-mind cancellation and return rights may be restricted in accordance with applicable law. This does not affect statutory rights where an item is faulty, not as described or otherwise does not conform to the contract.

Finance & third-party services
Where finance or another third-party service is made available in connection with a transaction, the service may be provided by an independent provider under its own terms, eligibility requirements and privacy information.
Any finance application is subject to the provider's approval and HTW does not guarantee that finance will be available or approved. Where relevant, your contract with the finance provider is separate from these Terms & Conditions.

Website use & intellectual property
The content of the HTW website, including its branding, layout, written content, graphics and original website materials, is owned by or licensed to HTW unless otherwise stated and is protected by applicable intellectual property law.
You may use the website for personal and lawful purposes. You must not misuse the website, attempt unauthorised access, interfere with its operation, introduce malicious material or reproduce HTW-owned content commercially without appropriate permission.
Third-party brand names, watch model names, logos and trademarks remain the property of their respective owners.

Liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability that cannot lawfully be excluded under applicable consumer law.
HTW is not responsible for losses caused by events outside our reasonable control or for losses that were not reasonably foreseeable when the relevant contract was formed, subject always to rights and liabilities that cannot lawfully be limited.
If you are purchasing as a consumer, these terms do not exclude or restrict your statutory consumer rights.

Privacy, cookies & communications
Our Privacy Policy explains how we collect and use personal information. Our Cookie Policy explains our use of cookies and similar technologies.
Where you communicate with us by email, telephone, WhatsApp, website form or another channel, we may retain an appropriate record of the communication for customer service, transaction, fraud-prevention, legal and business-record purposes in accordance with our Privacy Policy.

Complaints
If you are unhappy with a product, service or experience with HTW, please contact us so that we have an opportunity to investigate and respond.
Our Complaints Policy explains the process for raising a complaint. We ask customers to raise concerns as soon as reasonably possible and, where possible, within 2–3 days of the relevant event or issue. This request does not affect any statutory rights you may have.

Changes to these terms
We may update these Terms & Conditions from time to time to reflect changes to our services, business practices or applicable requirements.
The terms applicable to a transaction will generally be those in force when the relevant contract is made, unless a change is required by law or is otherwise validly agreed.

Governing law & statutory rights
These Terms & Conditions and any contract between you and HTW are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to you.
If you are a consumer, you may have the right to bring proceedings in the courts applicable to where you live. Nothing in these terms is intended to remove any mandatory legal right or remedy available to you.
High Toned Watches deals in high-value luxury items, many of which are pre-owned and individually sourced. Availability, condition, accompanying accessories and market pricing can therefore vary between individual pieces. Please raise any feature that is particularly important to you before completing a transaction.
